The second book produced by the Parliamentary Agricultural Front (FPA), on the Agro Law (13,986/2020) and its implementation, was held this Thursday (18) and had agribusiness titles as its theme. The debate was attended by the former secretary of Agricultural Policy at Mapa, Ivan Weekend; the representative of Ver Securitizada a, Victória de Sá; the executive director of CCAB Projetos, David Telo; and the representative of VBSO Advogados, Renato Buranello.
Federal deputy Pedro Lupion (DEM-PR), rapporteur of the project that originated the standard, mediated the live and explained that the objective is to hear the opinion, criticism and suggestions of experts on the subject, pointing out what will work and what still needs to be done. improved so that these bonds can be instruments for leveraging financing for Brazilian agribusiness. “We have no doubt that this law constitutes a new stage in the regulatory framework for agribusiness financing in the country.”
At the meeting, the representative of VBSO Advogados, Renato Buranello, highlighted the gains obtained with the changes brought by law 13.986/20 for agricultural titles. “It is the key that closed a cycle, moving towards greater exposure to other agents such as exchange rate variation.”
He argued that the use of storage titles, representing deposits of products and agribusiness waste CDAWA – Agricultural Deposit Certificate – needs to be better optimized. “With the Covid-19 pandemic, there was a drop in demand, so I have more products and nowhere to distribute them. Through agro titles, it will be possible to help the producer or agroindustry to sell it at a better time that will come, as soon as the pandemic is over. It is a financial operation that serves the corn, coffee and ethanol sector, an asset that can be purchased with extremely low risk and sold later at a good price.” For the former secretary of Agricultural Policy at Mapa, Ivan Wedekin, the Agro Law became a great source of financing for agribusiness.
Input distributor – During the discussion, the executive director of CCAB Projetos, David Telio warns that the input distributor was not included in the legislation. He says that his economic and financial life is very limited. “We need to start stretching the law a little from side to side to see if we can capture opportunities. When we help a fertilizer, seed, and pesticide industry, for example, I am not helping in isolation, it is automatically the rural producer who wins. There are a lot of opportunities to put on the table, we need to speed up all of this to start happening.”
Still on live, the representative of Vert Securitizadora, Victória de Sá highlights that Law 13,986/20 has to be seen as an alternative financing opportunity. “When we talk about the law we want more people giving money to agribusiness, we don't just want banks, we don't just want government, we want more people to be able to do this, including individuals, with more financing possibilities. ”
Victória de Sá emphasizes that digitalization needs to be brought to guarantees because nowadays you run into problems with notary offices. “The CIR – Cédula Imobiliária Rural – is also a solution that we will have to see how it develops: being able to make a fiduciary sale of a part of your farm will help producers a lot in not having to give all their guarantee to a bank only. This will help people obtain other financing.”
To conclude, the representative of Vert Securitizadora explains that understanding the risks of securities and having legal security is very important because the financial market is still very far from agribusiness. “Our mission is to bring these worlds ever closer together.”
