According to the agency, the measure complies with the determination of the National Energy Policy Council (CNPE).
The ANP Board approved this Wednesday (29) amendment to ANP Resolution No. 791/2019. The objective is to include devices that will deal with the systematic reduction of distributors' individual targets, as authorized by the National Energy Policy Council (CNPE) through Resolution No. 08/2020, art. 2nd, relating to the acquisition of biofuels through long-term supply contracts, and which adds, in another of its provisions, that such reduction must occur in the form of ANP regulation.

Thus, aiming to comply with the CNPE's determination, subject to intense studies and social participation, including technical meetings, workshops, consultations and public hearings, it provides, in short, conditions and systematics for reducing individual annual targets assigned to fuel distributors, by acquisition of biofuels through supply contracts signed between these economic agents and biofuel producers holding the Certificate of Efficient Biofuel Production issued within the scope of RenovaBio.
Among the main changes to ANP Resolution No. 791, of 2019, are:
– setting minimum contractual deadlines, for the purposes of applying the reduction, the same for all biofuels;
– possibility of the contract being signed with the biofuel producer’s headquarters or producers’ cooperative;
– the volume of biofuel contracted and withdrawn will be multiplied by the emission factor of Decarbonization Credits (CBIO) corresponding to each biofuel producing unit, according to the Certificate of Efficient Biofuel Production in force at the time of generating the necessary ballast for the primary emission of CBIO;
– limitation of the reduction of the distributor's individual target to 20%, in compliance with the provisions of art. 7th of Decree No. 9,888, of 2019, regardless of the number of contracts and volume;
– annual verification of compliance with the contract, for the purpose of reducing the target, according to the date of the electronic invoices sent through the CBIO Platform during the contract period, so that distributors will be able to benefit from the target reduction annually, even if the contract lasts for several years.
The main results arising from these changes include, among others: incentives for long-term contracts with biofuel producers with a higher Energy-Environmental Efficiency Rating; expansion of the production and use of biofuels, with positive externalities for the environment and security of supply; and increasing the predictability of the CBIOs market.
