President Jair Bolsonaro issued this Thursday (22) a decree that regulates and changes the name of the Social Fuel Seal to the Social Biofuel Seal, reports “Agência Brasil”. Granting the right to use the seal allows the biodiesel producer to have access to reduced PIS/Pasep and COFINS rates, which vary according to the raw material purchased and region of acquisition.
The measure aims to increase the inclusion of family farming by allowing both agricultural cooperatives, which do not have a Declaration of Aptitude for the National Agriculture Strengthening Program (Pronaf), and institutions that sell the production of family farmers to be qualified and recognized by the Ministry of Agriculture, Livestock and Supply (Mapa) as entities able to sell raw materials from family farmers within the scope of the National Biodiesel Production and Use Program – PNPB.

The decree maintains the reductions in PIS/Cofins contributions at the same levels and there is no increase in the number of beneficiaries. This way, there is no additional tax waiver.
The Ministry of Agriculture will regulate the procedures and requirements for granting/renewing the Biofuel Seal, as well as supervising biodiesel producers. The folder will be responsible for setting the seal’s validity period.
The ministry will also establish the minimum percentage of family farmers that agricultural cooperatives must have among their members for the purposes of qualifying as suppliers of raw materials originating from family farming and granting the Social Biofuel seal to biodiesel producers.
