Leakage from garbage trucks could become an environmental crime

The spillage of leachate on the ground or into rivers and seas by garbage trucks can become an environmental crime. This is what Senate Bill (PLS) 54/2016 establishes, presented by senator Cássio Cunha Lima (PSDB-PB). The text adds this type of conduct to the environmental crimes in force in the legislation (Law 9,605/1998).

Slurry is a liquid substance that results from the rotting process of organic materials and is often found in landfills and landfills. According to a report from the World Health Organization (WHO), the pollution caused by one liter of leachate is equivalent to 100 liters of domestic sewage. Furthermore, the waste prevents the development of flora and fauna in the place where it is located.

In justification, Cássio Cunha Lima stated that the leakage of leachate from garbage trucks has become a common practice in several Brazilian cities, and that the substance requires correct packaging and treatment.

“Although the Environmental Crimes Law generally regulates the crime of pollution, we understand that this conduct requires express legal provision. Given the serious damage that the spillage of leachate from garbage trucks has caused to the soil and water resources, there is nothing more necessary than adding this conduct to the list of pollution crimes”, he stated.

The project will be analyzed by the Environment, Consumer Protection and Inspection and Control Committee (CMA), where it is being reported by senator Ataídes Oliveira (PSDB-TO). It will then go to the Constitution, Justice and Citizenship Commission (CCJ) where it will receive a final decision.
